What is AAA Arbitration? 

AAA Arbitration is a forum for resolving disputes like the federal and state court systems, but separately operated. Instead of taking a case to court, often times the parties choose, or are required by contract, to instead go to an arbitration forum to have their case heard, like the American Arbitration Association. In arbitration, the parties present their cases in writing and at hearing with a procedure for doing so similar to court, and one or several arbitrators issues a ruling or "award" like a jury's verdict or court judgment. Compliance with the arbitration award is then mandatory like a court judgment, and an arbitration award can be turned into a court judgment. 

How do I know if I am required to go to arbitration or court? 

Often times, parties have a legal obligation to go to arbitration instead of court to address their dispute. Typically, that obligation arises from contract. In your day to day life, you sign or agree to many contracts, whether at the doctors office, or hiring a professional service, or using a website and agreeing to the company's terms and conditions. Other times, the parties may both consent to having their dispute heard in an arbitration forum. Whether a party is ultimately bound to arbitration or has rights that may be addressed in court, can be a complex question, and should be determined by your attorney. Sometimes arbitration clauses are determined to be inapplicable, though they are usually upheld. Filing in the wrong forum may have negative consequences, including loss of rights, adverse rulings, and even an obligation to pay the attorney's fees of the other side. 
What are the advantages of going to an arbitration forum like AAA arbitration? 
Arbitration may have advantages and disadvantages. For one thing, the process is more streamlined with less formality than a court and can often times be faster. The fees and costs however may often be more than in court, while attorneys fees may be less. There are a number of factors that may affect advantages and disadvantages of court and arbitration, and you should hire an attorney familiar with the process to advise you. Arbitrators are usually not standing judges, and do not have the same requirements and restrictions. There are no jury trials in arbitration, and the arbitrator serves as both the finder of fact and determiner of law.
Are AAA arbitration awards binding? 

Generally, arbitration awards are binding. This is why you should have a qualified AAA arbitration attorney advising you, and take the matter as seriously as a court trial. Arbitration awards are not appealable based on most errors of law, making them in some ways even more binding than a court decision. There are very narrow exceptions to these, in which case a court may review an arbitrator's decision for very narrow categories of certain types of errors. Many cases can be resolved through negotiations and mediation with the right counsel representing all parties.
